Ocean View Stables — Terms and Conditions

These Terms and Conditions (“Agreement”) govern all lessons, rides, and services (“Services”) provided by Ocean View Stables, located at 2152 Olympic Way, Daly City, CA 94015 (“Company,” “We,” “Us,” or “Our”).

By booking, purchasing, or participating in any Ocean View Stables activity, you (“Client,” “Rider,” “Student,” “Leaser,” or “You”) acknowledge and agree to all terms set forth below.

1. All Sales Final — No Refund Policy

1.1 Final Sale

All sales, lesson payments, deposits, and fees paid to Ocean View Stables are final.

There are no refunds, credits, or reimbursements under any circumstance, including but not limited to:

  • Weather changes or cancellations due to unsafe conditions.

  • Illness, travel delays, or personal scheduling conflicts.

  • Change of mind, dissatisfaction, or failure to attend.

  • Early termination of a subscription, lease, or program.

Once payment is received, you are financially committed to the scheduled service or program.

1.2 Compliance with California Civil Code §1723

Pursuant to California Civil Code §1723, Ocean View Stables clearly and conspicuously discloses that all sales are final and non-refundable prior to accepting payment.

By completing your purchase, you confirm that you understand and accept this no-refund policy.

1.3 No Money-Back Guarantee

Ocean View Stables provides equine experiences and education.

We make no guarantee of performance, satisfaction, or outcome.

Participation is voluntary, and you assume all inherent risks associated with equestrian activities.

2. Rescheduling Policy (Only Accommodation Offered)

2.1 Advance Notice Required

Lessons, trail rides, or experiences may be rescheduled once per booking with at least 24 hours’ advance written notice via text or email.

Requests made within 24 hours of the scheduled session or failure to attend will result in forfeiture of that session.

2.2 Availability and Expiration

Rescheduling is subject to instructor and horse availability.

All rescheduled sessions must be completed within 30 days of the original booking date or will be forfeited.

No credits, transfers, or extensions beyond that period will be issued.

2.3 Definition of Reschedule

A reschedule is a one-time courtesy allowing the same participant to take the same booked service on a different date.

It does not entitle you to refund, transfer, or substitute a different service.

3. Lesson Programs and Commitments

3.1 Discount Eligibility and 6-Month Commitment

Discounted lesson package pricing is available only to participants who commit to a minimum six-month term (“Commitment Term”).

This commitment is contractual and binding for the full duration.

If you cancel before completing the six-month term, Ocean View Stables reserves the right to retroactively adjust all prior lessons to the standard single-lesson rate and collect the difference immediately.

3.2 Lesson Expiration and No Rollovers

All included lessons must be used within the calendar month.

Unused lessons do not roll over and are forfeited at the end of each billing cycle.

3.3 Payment Terms

Payments are due in advance.

Unpaid or declined payments may result in immediate suspension of lesson privileges without refund.

4. Chargebacks, Disputes, and Payment Reversals

4.1 Waiver of Chargeback Rights

By signing or agreeing electronically to this Agreement, you expressly waive the right to dispute charges (“chargeback”) with your credit card issuer or bank for any reason, including but not limited to dissatisfaction, scheduling changes, or non-attendance.

4.2 Proof of Service and Attendance

Ocean View Stables maintains attendance logs, instructor notes, and waiver signatures.

Any material participation, attendance, or use of the facility constitutes full delivery of service under Federal Trade Commission (FTC) billing dispute guidelines.

4.3 Fees and Collection

If a chargeback is initiated, Ocean View Stables reserves the right to recover the disputed amount, plus any related fees, administrative costs, and attorney fees through collection or legal action.

Unpaid balances may be referred to collections.

5. Horse Leasing

5.1 Lease Terms

Leases are final for their duration.

All lease payments are non-refundable.

Early termination does not relieve the lessee from full payment obligations.

5.2 Responsibility for Care

Lessee assumes full responsibility for any injury or damage caused while the leased horse is under their care or use.

6. Trail Rides, Pony Rides, Kids Camps, and Clinics

6.1 Waiver Requirement

All participants must sign a Release of Liability Waiver prior to participation.

Failure to sign will result in cancellation without refund.

6.2 Assumption of Risk

Horseback riding involves inherent dangers including serious injury or death.

By participating, you voluntarily assume all risks and release Ocean View Stables, its owners, and affiliates from liability.

7. Art Studio Pods

7.1 Final Sale Policy

All Art Studio Pod rentals are non-refundable and non-transferable.

Early departures, schedule changes, or dissatisfaction do not qualify for refund or credit.

7.2 Experience Requirement

All renters must participate in a scheduled Ocean View Stables experience (e.g., Sip & Paint, Lesson, or Trail Ride) as part of the program.

8. Liability and Indemnification

You agree to release, defend, indemnify, and hold harmless Ocean View Stables, its owners, employees, contractors, and affiliates from any and all liability, claims, or damages arising from your participation, including personal injury or property loss, whether caused by negligence or otherwise.

9. Governing Law

This Agreement shall be governed by and construed under the laws of the State of California, with venue exclusively in San Mateo County.

Any legal dispute shall be resolved through binding arbitration or small claims in that jurisdiction.

10. Modification of Terms

Ocean View Stables reserves the right to modify or update these Terms and Conditions at any time.

Updated terms will be posted publicly and effective immediately upon publication.

11. Acknowledgment and Acceptance

By completing a booking, signing a waiver, or participating in any Ocean View Stables service, you acknowledge that:

  • You have read and understood these Terms and Conditions in full.

  • You understand and agree that all sales are final and no refunds or chargebacks will be issued for any reason.

  • You accept that rescheduling is the only modification allowed.

  • You agree that these terms constitute a legally binding contract.
