Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of the services provided by Ocean View Stables, a [Your Business Type] ("Company", "We", "Us", or "Our"). By booking any service or engaging in any of the activities offered by the Company, you ("Client", "Student", "Rider", "Leaser", "You", or "Your") agree to be bound by the following terms:

1. Monthly Club Subscription Lessons

1.1 Subscription and Lesson Details

The Monthly Club Subscription grants you a set number of lessons per month ("Included Lessons"). These Included Lessons cannot be carried over to the next month and must be used within the calendar month in which they are allocated.

Lessons are non-refundable and non-transferable.

Additional lessons beyond the set number included in your subscription may be available for an additional charge, subject to availability and at the sole discretion of the Company.

1.2 Price Lock and Contract Term

The subscription price ("Subscription Price") is locked in for the initial term of six (6) months ("Initial Term").

After the Initial Term, the Subscription Price may change based on the prevailing rate at that time. The price may increase, decrease, or remain the same at the sole discretion of the Company.

1.3 Price Lock Guarantee

To lock in your Subscription Price beyond the Initial Term, you may opt to prepay for one (1) year in advance.

The Price Lock Guarantee ensures that the Subscription Price will remain unchanged for the full one-year term, except for adjustments related to the Cost of Living Adjustment (COLA) inflation. Any COLA increase will be based on the standard rate of inflation as determined by [relevant government or authoritative body] at the time of renewal.

Note: The Price Lock Guarantee does not apply to any first-year discounts, which are separate from the Subscription Price and are subject to adjustment based on the Company's pricing strategy.

1.4 First-Year Discounts

We may offer a first-year discount on the Subscription Price. However, this discount is applied exclusively to the first year of your subscription and will not be subject to the Price Lock Guarantee.

After the first year, the Subscription Price may revert to the standard rate, and the Price Lock Guarantee may be applicable based on the terms set forth herein.

1.5 Payment Terms

Payments for the Monthly Club Subscription are due on the [insert due date] of each month and must be made in full prior to the commencement of each month's lessons.

If you opt for the one-year prepayment option, the full amount for the upcoming year must be paid in advance before the first lesson of the term.

1.6 Cancellation and Termination

The Minimum Term for the Monthly Club Subscription is six (6) months. You may cancel your subscription at any time after the Initial Term by providing written notice to the Company. However, no refunds will be provided for payments already made.

The Company reserves the right to terminate your subscription at its sole discretion if you fail to comply with any of the terms outlined in this Agreement.

2. Horse Leasing

2.1 Leasing Options

You may lease a horse for 1-3 days per week, 4-5 days per week, or on a full lease basis. The following responsibilities apply:

  • 1-3 Days per Week Lease:
    You are not responsible for routine vet bills, farrier costs, or other regular horse maintenance needs. However, you are fully responsible for any injuries that occur while the horse is ridden by you.
  • 4-5 Days per Week Lease (Half Lease):
    You are responsible for 50% of any scheduled horse care costs, including but not limited to routine vet checks, vaccines, farrier services, supplements required by the vet. You are fully responsible for any injuries sustained while riding the horse.
  • Full Lease:
    You are fully responsible for all horse care, including routine and emergency vet care, farrier work, grooming, and bathing materials. Additionally, you are responsible for any extra care needs outside of basic boarding, including supplements and additional maintenance.

3. Trail Rides, Pony Rides, and Kids Camps

3.1 Waiver Requirement

All participants in trail rides, ponies rides, and kids camps must sign a waiver before participating in any horseback riding activity.

The waiver will be provided online for your convenience, and a physical copy will be provided upon arrival at the facility.

3.2 Acknowledgment of Risk

By signing the waiver and participating in these activities, you acknowledge and accept the inherent risks of horseback riding, including but not limited to injury or accidents.

You voluntarily assume these risks and understand that signing the waiver is one of the many steps taken to ensure you are fully informed of these risks.

4. Art Studio Pods

4.1 Rental Details

The Art Studio Pods are available for commercial lease for periods of 2-7 days at a time.

To rent a pod, you must sign a commercial lease agreement for the duration of your stay.

4.2 Waiver Requirement

In addition to the commercial lease agreement, you will be required to sign a waiver related to the horse-related activities at the facility during your stay.

4.3 Experience Requirement

Art Studio Pods are part of a larger experience at Ocean View Stables. You must sign up for one of our experiences, such as Sip and Paint, Horsemanship Clinics, Horse Kids Camp, Lessons, or Trail Rides, to rent an Art Studio Pod.

5. Liability and Indemnity

The Company is not responsible for any loss, injury, or damage resulting from your participation in any activities, including but not limited to lessons, trail rides, horse leasing, and other experiences.

By engaging in any service or activity, you agree to indemnify and hold the Company harmless from any claims, losses, or damages that may arise as a result of your participation.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of California, Daly City, without regard to its conflict of law principles.

7. Modifications to the Agreement

The Company reserves the right to modify, update, or amend these Terms and Conditions at any time. Any changes will be communicated to you in writing, and your continued participation in any service after such changes shall constitute your acceptance of the revised Terms and Conditions.
